Determining whether the driver’s liability insurance or rideshare company’s liability insurance is primary or secondary coverage, can be dependent upon whether the driver was “within the scope of employment” and working for Uber or Lyft at the time of the accident. This often depends on whether the driver was carrying passengers, dropping off passengers, or on the way to pick up passengers. The same considerations should also be made when deciding as to whether there is applicable underinsured or uninsured motorist coverage through the driver or rideshare company.

In all scenarios, however, the distinction between whether the driver’s personal policy or commercial policy applies will be dependent upon the specific language of the insurance policy.
